Terms of Service

Using WunderGuide

1. Acceptance of Terms

By creating an account or otherwise using the WunderGuide mobile or web apps (the “Service”) provided by JNSQ Labs LLC dba WunderGuide. (“JNSQ,” “we,” “our”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service.

2. Eligibility & Accounts

• You must be at least 13 years old (or the age of digital consent in your jurisdiction) to create an account.
• You agree to provide accurate, complete information and keep it updated.
• You are responsible for safeguarding your password and all activity under your account.

3. Acceptable Use

You agree not to:

• Violate any applicable law or regulation.
• Upload or transmit malicious code, hate speech, or unlawful content.
• Reverse engineer, decompile, or attempt to extract the Service’s source code.
• Use automated scripts to collect data or interact with the Service without permission.

4. Content & Intellectual Property

• All text, graphics, UI, trademarks, and code in WunderGuide are owned by JNSQ or its licensors.
• We grant you a limited, revocable, non-exclusive license to use the Service for personal, non-commercial purposes.
• User-generated content remains yours, but you grant JNSQ a worldwide license to display and process it in connection with the Service.

5. Payments & Bookings

Future features may allow purchases or reservations. Payments will be processed by trusted third-party providers (e.g., Apple, Google, Stripe). Additional terms presented at checkout will apply.

6. Third-Party Links & Data

The Service pulls data from external APIs (Foursquare, Google, NOAA, OpenAI, etc.). We do not endorse or control third-party content and are not liable for your reliance on it.

7. Disclaimer of Warranties

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, JNSQ disclaims all warranties—express, implied, or statutory—including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, JNSQ, its founders, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of—or inability to use—the Service, even if we have been advised of the possibility of such damages. Our total liability will not exceed US $100 or the amount you paid us in the past 12 months, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless JNSQ from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.

10. Termination

We may suspend or terminate your account at any time for any reason, including breach of these Terms. You may stop using the Service at any time. Sections 4–9 survive termination.

11. Updates to Terms

We may modify these Terms at any time. Changes take effect immediately upon posting in the app. Continued use constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of Hawaii, USA, without regard to conflict-of-law provisions. You agree to the exclusive jurisdiction of courts located in the City & County of Honolulu, Hawaii.
